RIGHTSCONFERRED BY REGISTRATION trade mark act -
Registration, if valid, grants exclusive right touse of trade mark to the proprietor in relation to goods or services in respectof which the trade mark is registered,, subject to conditions and limitationsprescribed, if any, and subject to other provisions of thee Act. [Section28(1)]. In case same or similar trade mark is registered in name of more thanone proprietors, they do not have any right against each other, but have equalrights against third persons. [Section 28(3)]. - - The registration and itsassignments and transmissions are prima facie evidence of its validity in anylegal proceedings [section 31(1)].
